Who we are
Backyard Plans is based in Auckland, New Zealand. You can reach us at hello@backyardplans.co.nz.
What you're buying
Each purchase is a digital plan pack for one design: the plan set PDF, the GIB EzyBrace bracing printout, the cutting list and the guides described on that design's page. It's a set of documents, not a building service. Please read the design's "Before you buy" page, which forms part of these terms.
Your licence to use the plans
- You may use the plans to build one building of that design on one site, and print or share them with your builder, council, suppliers and anyone else involved in that build.
- You may not resell, republish or share the plans for anyone else to build from, or sell buildings built from them as a product.
- The drawings, calculations and documents stay the copyright of Backyard Plans.
Want to build more than one? Email us and we'll sort out a fair price.
Price and payment
Prices are in New Zealand dollars. Payment is taken by Stripe on a secure checkout page; we never see or store your card number.
Delivery
Your plan pack is emailed to the address you gave at checkout as soon as payment goes through, usually within a few minutes. If it hasn't arrived within an hour, check your spam folder, then email us with the email address you paid with and we'll send it again.
Checking your site before you buy
It's your responsibility to check the design suits your site before you buy and build: the wind zone (each design states its range, and none are for Extra High wind zones, lee zones or sites needing specific engineering design), the exemption conditions, boundary distances and your district plan rules. You'll be asked to confirm your wind zone before checkout.
Faulty files and errors
- If a file is missing, corrupted or won't open, email us and we'll fix or replace it. If we can't, we'll refund you in full.
- If you find an error in the plans, tell us. We'll check it, and if it's a genuine error we'll correct it and send you the revised version free of charge.
Refunds
Because the plans are digital and delivered immediately, we don't offer refunds for change of mind, including where you decide not to build or find the design doesn't suit your site after buying. This doesn't limit any refund you're entitled to under the Consumer Guarantees Act (for example, if the plans aren't of acceptable quality or don't match their description). If something's gone wrong with your order, email us and we'll do our best to sort it out. Our refund policy sets out when we'll refund, including wrong-design swaps.
Your rights under New Zealand law
Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where you're buying as a consumer. If you're buying for the purposes of a business, the Consumer Guarantees Act does not apply, to the extent the law allows.
Liability
We draw the plans with care, but we don't supervise or inspect construction. To the extent the law allows, we're not liable for loss or damage arising from how a building is built or used, from changes made to the design, or from using materials or methods other than those specified. Where we are liable and the law allows a limit, our total liability is limited to the price you paid for the plan pack.
Versions
Each plan set carries a version number (for example v1.1). If we revise a design, we'll try to make the new version available to past buyers, but you should build from the version you bought and keep a copy for your records.
Changes to these terms
We may update these terms from time to time. The terms that apply to your purchase are the ones on this page when you bought.
Governing law
These terms are governed by New Zealand law.
